Gifting a Car or Transferring It to Family
California treats a genuine gift, and most transfers between close family members, differently from a sale in two ways that save real money: no use tax, and for qualifying family transfers no smog certificate. The transfer itself still has to be filed, with the same 10-day clock as any other change of ownership.
Who counts as family
The family exemption covers transfers between spouse, domestic partner, parent, child, grandparent, grandchild, and siblings. Those transfers are exempt from the smog certification requirement and, when no money changes hands, from use tax. Aunts, uncles, cousins, and in-laws are not on the list; a transfer between them is treated like a sale for smog purposes even if it is a gift for tax purposes.
Gifts to anyone else
A true gift to a friend or non-qualifying relative skips use tax, because there is no purchase price, but a smog certificate is still required unless the vehicle is otherwise exempt (gas vehicle 4 model years old or newer, electric, or a biennial smog filed within 90 days). The DMV values a gift at the vehicle's market value for record purposes, which matters for the vehicle license fee going forward.
The one form that makes it work
A REG 256 Statement of Facts is where the gift or family relationship is declared; it is what exempts the transfer from use tax and, for family, from smog. Without it the DMV assumes a sale. The signed title (seller on the front, new owner on the back), odometer reading for vehicles 2010 and newer, and the transfer fee complete the filing. We prepare the REG 256 and file the whole transfer from photos.

Common questions
Do I pay sales tax on a car my parent gave me?
No. A transfer between parent and child with no money changing hands is exempt from use tax when a REG 256 declares it as a family transfer or gift.
Does a gifted car need a smog check in California?
Between qualifying family members, no. A gift to anyone else needs a smog certificate unless the vehicle is exempt for another reason.
Can I put a low sale price to avoid tax instead?
Under-reporting a sale price is fraud, and the DMV can assess tax on market value. A genuine gift declared on a REG 256 is legal and simpler.
